Our stance on AI

We have watched friends and whole teams lose their livelihoods to AI, and we are saddened by the wave of organisations cutting workers in its name. Those were real careers, and real craft.

We believe games need human hands. Engineering, art, design, lore, audio — every domain of this craft carries the fingerprints of the people who made it, and that is precisely what players feel when they play. No model replaces that.

We also believe AI tools, in the hands of seasoned professionals and with strong guidance for those earlier in their careers, can raise the quality and the output of every part of development. So we use them as instruments, alongside our people, never in place of them.

That is the line we hold: technology in service of the team, not the other way around.

Privacy policy

Tainted Studios Pty Ltd (ACN 687 553 555) (“Tainted Studios”, “we”, “us”) is an independent game studio based in New South Wales, Australia. This policy explains how we collect, use, share and look after personal information through taintedstudios.com, in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. What we collect

  • Game updates: your email address, when you subscribe.
  • Joining the team: your name, email address, what you do, any portfolio or profile link, and what you tell us about yourself.
  • Projects: your name, email address, company, and what you tell us about your project.
  • Getting in touch: your name, email address and your message.
  • Visiting the site: like any website, our hosting provider automatically receives technical information such as your IP address, your browser and device type, and the pages you request.

If you email us, we’ll have whatever your email contains. We don’t ask for sensitive information, such as health information, so please don’t send it.

How we collect it

Directly from you, when you use a form on this site or email us, and automatically from your browser when you visit. Now and then someone else may pass on your details, such as a referee or a recruiter acting for you.

Cookies

We don’t use cookies, analytics or advertising trackers. The site remembers two preferences in your browser, whether you paused the motion and whether you’ve already seen the intro. They stay on your device and aren’t sent to us. The site’s typeface comes from Google Fonts, so your browser connects to Google to fetch it.

Why we use it

  • To discuss, quote for and deliver projects you ask us about.
  • To run, secure and improve the site, and to guard against spam and misuse.

We use your information only for the purpose you gave it to us, a related purpose you’d reasonably expect, or as the law allows. We don’t sell or rent it, and we don’t use it to make automated decisions about you.

Game updates

We’ll only email you updates if you subscribe. Every one has an unsubscribe link, and we’ll act on your request within five working days.

Who we share it with

Only the service providers who help us run the site and our communications: our hosting provider (Google Firebase), our font provider (Google Fonts), and the services we use to send email updates and receive form messages. They may use it only to provide their services to us. We may also share information with our professional advisers, when the law requires or allows it, or as part of a sale or restructure of our business.

Outside Australia

Some of these providers store or process information outside Australia, including in the United States and other countries where they or their suppliers operate. We choose providers with strong security and privacy practices, and take reasonable steps to make sure they handle your information in line with the Australian Privacy Principles.

Keeping it safe

We keep personal information in secure, access-controlled services, and only the people who need it can see it. No system is completely secure, but we take reasonable steps to protect your information from misuse, interference and loss, and from unauthorised access, change or disclosure. If a data breach is likely to cause you serious harm, we’ll tell you, and the Office of the Australian Information Commissioner (OAIC) where required.

How long we keep it

Your email address stays on our updates list until you unsubscribe. We keep job applications for up to 12 months, so we can consider you for future roles, unless you ask us to delete yours sooner. We keep enquiries and messages for as long as we need them to reply and to keep reasonable business records. After that, we delete the information or remove anything that identifies you.

Seeing and correcting your information

You can ask to see, correct or delete the personal information we hold about you by emailing support@taintedstudios.com. There’s no charge. We’ll reply within 30 days, and may need to confirm who you are first. If we can’t do what you ask, we’ll explain why. If you live outside Australia, you may have further rights under your local privacy law, such as the GDPR; email us and we’ll help.

Staying anonymous

You can browse the site without telling us who you are. To reply to you or consider an application, we need your name and a way to contact you.

Children

This site isn’t directed at children, and we don’t knowingly collect personal information from anyone under 16. If you think a child has sent us their details, let us know and we’ll delete them.

Complaints

If you’re concerned about how we’ve handled your personal information, email support@taintedstudios.com. We’ll look into it and reply within 30 days. If you’re not satisfied with our response, you can lodge a complaint with the OAIC at oaic.gov.au, or call them on 1300 363 992 for advice.

Changes to this policy

We may update this policy from time to time. The current version is always on this site, with the date it last changed at the top.

These terms apply to your use of taintedstudios.com (the site), run by Tainted Studios Pty Ltd (ACN 687 553 555) (“Tainted Studios”, “we”, “us”), a company based in New South Wales, Australia. By using the site, you agree to them. If you don’t agree, please don’t use the site.

Using the site

You may use the site for lawful purposes only. Please don’t interfere with how it works or how others use it: for example, by trying to gain unauthorised access, introducing malicious code, overloading it, or using it to send spam. We may change, suspend or withdraw any part of the site at any time.

Our work

Everything on the site, including the kangaroo, the artwork, the 3D models, the text, the code, and our names and logos, belongs to Tainted Studios or to those who license it to us, and is protected by copyright and trade mark law. You’re welcome to browse and to share links to the site. Please don’t copy, reproduce, adapt or distribute any of it, use it commercially, or use it to train AI or machine-learning models, without our written permission.

These terms cover this website only. When our games are released, they’ll come with their own licence terms, as well as the terms of the store or platform you get them from.

What you send us

When you use our forms or email us, you confirm that what you send is accurate and yours to share. We handle personal information as our privacy policy describes.

Unsolicited ideas

We don’t accept unsolicited game ideas, pitches, stories or other creative material, so please don’t send them. If you do, we can’t keep them confidential, review them or pay for them, and we may already be working on, or later develop, something similar on our own. This doesn’t cover a portfolio you send with a job application, or the details of a project you’d like us to work on for you: we treat those as the start of a conversation.

Links to other websites are there for your convenience. We don’t control those sites, and we aren’t responsible for their content or for how they handle your information.

No guarantees

The site is for general information. We work to keep it accurate and available, but we don’t promise that it will be complete, up to date, uninterrupted or free of errors. Details of games in development, such as features, platforms and release dates, may change.

Your rights under Australian law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, or any other law, that can’t be excluded. Subject to that, and to the extent the law allows, we aren’t liable for any loss or damage, including indirect or consequential loss, arising from your use of the site or your inability to use it.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts and the courts that can hear appeals from them. If any part of these terms can’t be enforced, the rest still applies.
